TERMS AND CONDITIONS

PURPOSE: This constitutes an order for videography services. Its is understood that any and all sample prints and tape remain the property of Omni Video Productions (hereafter called THE COMPANY) and that they may be used for advertising, display, videography competition or any other purpose thought proper by THE COMPANY.

LIABILITY: THE COMPANY takes the utmost care with respect to exposure, transportation and handling of the tape/tapes. However, in the unlikely event that all of the video should be lost, stolen, damaged or destroyed for reasons within or beyond THE COMPANY ‘s control, THE COMPANY ‘s liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of original tape/tapes shall be a prorated amount of the package selected, based on the percentage of originals lost.

Final Video Product: THE COMPANY will make every effort to give the Client the best audio and video recording possible, but makes no guarantee either expressed or implied, in regard to the quality of audio/video recordings that are subjective and influenced by many factors beyond the complete control of THE COMPANY, especially during live or unstaged events, like weddings. It is also understood that the client is hiring THE COMPANY for their technical and artistic expertise and, therefore, THE COMPANY reserves the right to edit the tape(s) as they see fit. THE COMPANY does not guarantee that everyone involved in the event will be videotaped or will be included in the final edited videotape.

Re-editing of Videotapes: Requests for changes to the final edited or non-edited videotape will be subject to an editing surcharge of $50.00 per hour plus TAX unless an obvious mistake was made by THE COMPANY. In which case, THE COMPANY will gladly re-edit the videotape at no additional charge to the Client.

Services to be supplied:

PRICING: The TOTAL PRICE for the videography services above are $_ ___________ for Videography service . and $_____________Editing - for a Grand Total of $____________ BALANCE of $ ____________no later than seven days prior to the event. This does include editing. Additional videographer time beyond services above and when requested by the Contracting Party is charged at $75.00 plus TAX per hour for videography and $50.00 per hour for editing and is payable at the time services are rendered.

PRE-EVENT CONSULTATION: The parties agree to a pre-event consultation approximately one to three weeks before the event date in order to finalize the actual shooting times, locations, event procedures and special requests for specific footage. Please see attached form for the type of information requested.

MODEL RELEASE: The contracting party grants THE COMPANY the unrestricted right to copyright, use and publish videos and/or photographs of the contracting party for commercial, promotion, competition or other purposes without compensation or liability to the contracting party. It is the responsibility of the client to advise any and/or all participants and attendees that the event will be videotaped. All parties attending the event will therefore be considered as consenting to be included in the final edited or non-edited video and/or commercial/promotional video by their presence.

It is the responsibility of the client to secure permission of the church, synagogue or other official to videotape the ceremony/event. The client shall insure the placement of the participants,attendants, the officiant(s) and the altar decorations so as to not obscure the view of the subject. THE COMPANY will abide by the rules of the church/synagogue in regards to camera placement at the ceremony.

COPIES/ORIGINALS: THE COMPANY may, but is not obligated to, retain copies and/or masters of the videotape. Federal Copyright Law protects all videotaped images produced by Omni Video Productions
